Intellectual Property and Green Technology: IP programs and solutions for your green business

Summary:

This month’s 4th Tuesday will focus on practical, business-oriented issues for green technology companies to protect their intellectual property and develop advertising strategies. More specifically, topics will include:

(1) An overview of IP as it relates to green technologies;

(2) Summary and discussion of U.S. Patent & Trademark Office’s new “Green Technology Pilot Program”, and similar programs in South Korea and the U.K.; and

(3) Summary and discussion of the Federal Trade Commission’s “Green Guides” on branding and false advertising issues relating to the advertising of green products and services.

David Saenz is an attorney at Greenberg Traurig LLP and focuses his practice on a wide range of intellectual property (IP) litigation and related disputes including green building, copyright, trademark, and patent law. In addition to his litigation experience, David has closed dozens of IP transactions in the areas of software licensing and entertainment agreements. David is accredited by the U.S. Green Building Council as a LEED Green Associate, and is also on the Greentech Committee for the Intellectual Property Section of the New York State Bar Association. David received his J.D. from Northwestern University in 2000 and is admitted to the CA and NY State Bars.

Gaston Kroub is an attorney at Greenberg Traurig LLP with substantial experience litigating patent and other IP cases. Gaston also concentrates on the Cleantech industry, and is the first registered patent attorney in the U.S. credentialed as a LEED Green Associate. Technical areas that Gaston has litigated and counseled clients in include: Internet business methods, financial services, software, recombinant DNA, automotive, consumer electronics, computer hardware, plastics, pharmaceuticals, and Web-based data mining. He has particular experience in the enforcement of patent rights overseas, including proceedings before the Taiwan and China patent offices, and the Chinese trial courts. Gaston received his J.D. from Yeshiva University in 2001 and is admitted to the NY and NJ State Bars.
